Eligible Entrants:

Entrant Group 1 – Consumers

Consumer entry is only open to Australian residents who are 18 years and over.

 

Entrant Group 2 – Independent Stores

Entry Group 2 consists of independent stores within Australia that are customers of the Promoter only, and excludes Exide National Account stores (“Eligible Independent Stores”).

 

Entrant Group 3 – National Accounts

Entry Group 3 consists of Exide National Account stores (i.e. Beaurepaires, Bridgestone, Maxiparts and Midas stores) within Australia that are customers of the Promoter only (“National Account Stores”).

 

Both Eligible Independent Stores and National Account Stores are collectively referred to as “Eligible Stores” herein.

 

All Eligible Stores must be within the Promoter’s trading terms throughout the Promotional Period and must not have overdue monies owing as at the draw date in order to be eligible to claim any prize.

How to Enter:

Entry Method – Entry Group 1 (Individuals)

To enter the Promotion, an entrant from Entrant Group 1 must complete the following steps during the Promotional Period:

  1. purchase any Exide Battery (“Promotional Product”) from any store within Australia displaying advertising for this Promotion (“Participating Venues”); and then

  2. visit www.exidebatteries.com.au follow the prompts to the Promotion entry page; and fully complete and submit the online entry form with their personal details (first name, last name, email address, mobile number and State/Territory of residence).

 

Proof of Purchase: The entrant must retain proof of purchase. The proof of purchase required is an original receipt for the Promotional Product purchased.

 

Entry Method – Entry Group 2 (Independent Stores) and Entry Group 3 (National Accounts)

To enter the Promotion, an Eligible Store must:

  1. display Point of Sale (POS) material within their store during the Promotional Period;

  2. purchase at least 300 units of the Promotional Product from a sales representative during the Promotional Period; and

  3. for stores that have purchased from the Promoter anytime between 05/06/16 and 31/12/16, they must also obtain an Eligible Purchase Percentage Increase (defined below) of at least 50%.

 

The Eligible Purchase Percentage Increase is determined by calculating the number of units of Exide Batteries purchased by the store from the Promoter during the Promotional Period (with the same period the previous year i.e. 05/06/16 and 31/12/16). E.g. if a store purchases 100 Exide Batteries between 05/06/16 and 31/12/16, and 150 Exide Batteries between 05/06/17 and 31/12/17, they will have obtained an Eligible Purchase Percentage Increase of 50%.

Entries Permitted:

Entry Group 1 (Consumers):

Consumers are eligible to enter multiple times, subject to the following:

(a) limit one (1) entry permitted per Promotional Product purchased during the Promotional Period; and

(b) each entry must be submitted separately and in accordance with the entry requirements.

 

Entry Group 2 (Independent Stores) and Entry Group 3 (National Accounts)

Eligible Stores:

  • that HAVE purchased from the Promoter between 05/06/16 and 31/12/16 will receive:

    • 1 draw entry if they obtain an Eligible Purchase Percentage Increase of between 50% and 74.99%; OR

    • 3 draw entries if they obtain an Eligible Purchase Percentage Increase of 75% or more; OR

  • that HAVE NOT purchased from the Promoter between 05/06/16 and 31/12/16, will automatically receive one (1) draw entry for completing the above entry requirements (purchase at least 300 units + display Point of Sale (POS) material during the Promotional Period).

The prize is an Ultimate Fishing Adventure for two (2) adults in NSW which consists of the following:

  1. Ultimate Fishing Adventure with Exide’s Micah Adams from Adventure Angler TV for the winner and a friend at Jervis Bay;

  2. Return transfers for the winner and a friend from Sydney CBD to Jervis Bay; and

  3. Two (2) nights' three-star twin share accommodation including select food and drinks.

If the Winner resides in ACT return economy flights for two (2) adults from Canberra to Sydney will be included.

Up to AUD$6,600.00 depending on date of departure

SA/NT Prize:

The prize is an Ultimate Fishing Adventure for two (2) adults in SA which consists of the following:

  1. Ultimate Fishing Adventure with Exide’s Micah Adams from Adventure Angler TV for the winner and a friend at Kangaroo Island;

  2. Return transfers for the winner and a friend from Adelaide CBD to Kangaroo Island; and

  3. Two (2) nights three-star twin share accommodation including select food and drinks.

If the Winner resides in NT return economy flights for two (2) adults from Darwin to Adelaide will be included.

Up to $6,000.00 depending on date of departure

QLD Prize:

The prize is an Ultimate Fishing Adventure for two (2) adults which consists of the following:

  1. Ultimate Fishing Adventure with Exide’s Micah Adams from Adventure Angler TV for the winner and a friend at Somerset Dam;

  2. Return transfers for the winner a friend from Brisbane CBD to Kilcoy; and

  3. Two (2) nights three-star twin share accommodation including select food and drinks.

Up to AUD$4,900 depending on date of departure

WA Prize:

The prize is an Ultimate Fishing Adventure for two (2) adults which consists of the following:

  2. Return transfers for the winner a friend from Fremantle to Rottnest Island; and

VIC/TAS Prize:

The prize is an Ultimate Fishing Adventure for two (2) adults which consists of the following:

  2. Return transfers for the winner a friend from Melbourne to Mornington Peninsula; and

  3. Two (2) nights three-star twin share accommodation including select food and drinks.

If the Winner resides in TAS return economy flights for two (2) adults from Hobart to Melbourne will be included.

Up to AUD$4,100 depending on date of departure

 

Prize Conditions:

Eligible Stores – Who Prize is Awarded: For any Eligible Stores, the Promoter’s head office will determine who from the winning Eligible Store will receive the prize (or will ask a manager or owner from the winning Eligible Store to nominate which employee, owner or manager, from the winning Eligible Store will receive the prize, subject to Promoter’s approval and subject to that employee/owner/manager accepting). The winner may take any person aged 18 years or over with them for the prize (it does not necessarily need to be an employee from the same winning Eligible Store).

 

The prize must be taken between February and April 2018, with exact dates of travel determined by the Promoter and subject to Micah Adams’s availability. If the winner cannot take the prize on the required dates for travel, they will forfeit their right to the prize and will not receive cash or any other alternative in lieu.

 

No part of this prize is exchangeable, redeemable for cash or any other prize or transferable.


Frequent flyer points will not form part of any prize.

 

Itinerary will be determined by the Promoter in its absolute discretion.

 

The winner and his/her travel companion must depart from and return to the same departure point and travel together.

 

Spending money, meals, taxes (excluding airline and airport taxes – these taxes only included where airfares provided as part of prize), airfares, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs, unless otherwise specified in the prize description herein, are not included.

 

Prize is subject to the standard terms and conditions of individual prize and service providers.

 

Travel itinerary will be determined by the Promoter in its absolute discretion.

 

Subject to the terms and conditions of the participating prize provider(s), if for any reason the winner does not, once the prize has been booked, take the prize (or an element of the prize) at the time stipulated, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.

Winner Notification:

The winners will be notified by email and phone within one (1) day of the draw. The winners will be published at www.exidebatteries.com.au by 16/01/18.

Unclaimed Prizes:

Prizes must be claimed by 24/01/18 at 1:00 pm AEDT. In the event of an unclaimed prize, the prize will be redrawn on 24/01/18 at 2:30 pm AEDT at Level 2, 35 Little Bourke Street, Melbourne VIC 3000 Australia. The winners of the redraw will be notified by email and phone within one (1) day of the redraw. The winners will be notified publicly (and their details published) at www.exidebatteries.com.au by 26/01/18.

 

  1. The entrant agrees and acknowledges that they have read these Conditions of Entry (and Schedule) and that entry into the Promotion is deemed to be acceptance of these Conditions of Entry (and Schedule). Any capitalised terms used in these Conditions of Entry have the meaning given in the Schedule, unless stated otherwise.

  2. The Promotion commences on the Start Date and ends on the End Date ("Promotional Period"). Entries are deemed to be received at the time of receipt by the Promoter and not at the time of transmission or deposit by the entrant. Records of the Promoter and its agencies are final and conclusive as to the time of receipt.

  3. Valid and eligible entries will be accepted during the Promotional Period.

  4. Employees (and their immediate families) of the Promoter, Participating Venues and agencies associated with this Promotion are ineligible to enter the consumer portion of this Promotion. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin

  5. Draws

    1. The draws will take place at Level 2, 35 Little Bourke Street, Melbourne VIC 3000 Australia at 02:30 pm AEDT on 15/01/18 using computerised random selection.

    2. The draw conductor may draw additional reserve entries in case an invalid entry or entrant is drawn.

    3. If a draw is scheduled on the weekend or a public holiday, the draw will be conducted at the same time and location on the following business day. The Promoter will ensure each draw is open for public scrutiny and anyone may witness the draw on request. The winner of a drawn prize is determined by chance.

    4. A total of fourteen (14) prizes will be awarded via this Promotion – five (5) prizes for Entrant Group 1 (Consumer entries); five (5) prizes for Entrant Group 2 (Independent Stores); and four (4) prizes for Entrant Group 3 (National Accounts).

    5. Entrant Group 1 – Consumers:

      1. Entries from Entrant Group 1 (Consumers) will be divided into the following five (5) State groups based on their location of the residence: NT/SA, WA, VIC/TAS, QLD or NSW/ACT (each a “Consumer State Group”). The first valid entry drawn in each Consumer State Group draw will win the prize indicated in the Schedule table above, relative to their State/Territory of residence. E.g. winner from NSW will win the NSW/ACT Prize.

    6. Entrant Group 2 – Independent Stores:

      1. Entries from Entrant Group 2 (Independent Stores) will be divided into the following five (5) State groups based on the location of the residence: NT/SA, WA, VIC/TAS, QLD OR NSW/ACT (each a “Independent Store State Group”). The first valid entry drawn in each Independent Store State Group draw will each win the prize indicated in the Schedule table above, relative to their State/Territory of residence. E.g. winner from NSW will win the NSW/ACT Prize.

    7. Entrant Group 3 - National Account Stores:

      1. Entries from Entrant Group 3 (National Account Stores) will be divided into the following four (4) groups: Beaurepaires, Bridgestone, Maxiparts and Midas. The first valid entry drawn from each aforementioned group will win the prize relative to their State/Territory of residence. E.g. winner from NSW will win the NSW/ACT Prize. However, if the prize in their State of residence is not available due to place limits, they will receive another of the trip prizes listed above (as determined by the Promoter – e.g. winner from NSW may win WA Prize), and will in addition, be awarded return economy flights for two (2) adults from the winner’s nearest capital city to the capital city where prize takes place (e.g. NSW winner in aforementioned example would receive return flights from Sydney to Perth). The total prize value for each Entrant Group 3 prize is therefore valued at up to AUD$7,400, based on most expensive Prize option awarded plus maximum potential flight costs.

  6. Cancelled and refunded orders or orders not completed by the required due date, will not be taken into consideration in determining whether an Eligible Store has met its purchase requirements. E.g. if an Eligible Store purchases 300 units of Exide Batteries during the Promotional Period only and subsequently refunds or cancels this purchase, they will not be eligible for this Promotion.

  7. All reasonable attempts will be made to contact each winner.

  8. If any winner chooses not to take their prize (or is unable to), or does not take or claim a prize by the time specified by the Promoter, or is unavailable at the designated time for the Event or at the time stipulated by the Promoter for travel, they forfeit the prize and the Promoter is not obliged to substitute the prize.

  9. Where entry is allowed by purchase or subscription, the cost of the product or service is no greater than the cost would be without the opportunity to participate in the Promotion.

  10. Consumer entrants must keep their proof of purchase specified in How to Enter for each entry as proof of purchase ("Proof of Purchase"). If a consumer entrant fails to produce the Proof of Purchase for a specific entry or each entry, as and when requested by the Promoter, the Promoter has the right to invalidate the entrant's respective entry/entries for which Proof of Purchase cannot be provided and/or all entries submitted by that entrant and/or forfeit the entrant's right to a prize. Purchase receipt(s) must clearly specify: (a) the store of purchase as a Participating Venue; (b) the required product/s or service/s to be purchased for entry; and (c) that the purchase was made during the Promotional Period and prior to entry.

  11. The value of the prizes is accurate and based upon the recommended retail value of the prizes (inclusive of GST) at the date of printing. The Promoter accepts no responsibility for any variation in the value of the prizes after that date.

  12. If a prize (or portion of a prize) is unavailable the Promoter reserves the right to substitute the prize (or that portion of the prize) to a prize of equal or greater value and/or specification, subject to any written directions of a regulatory authority.

  13. No entry fee is charged by the Promoter to enter the Promotion. Where entry is allowed online, there is no additional cost to enter the Promotion other than any cost paid by the entrant to access the website or social media platform of entry via their Internet service provider.

  14. Each prize will be awarded to the person named in the respective winning entry and any entry that is made on behalf of an entrant or by a third party will be invalid. If there is a dispute as to the identity of an entrant or winner, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant or winner.

  15. Entrants' personal information will be collected by the Promoter. Personal information will be stored on the Promoter's database. The Promoter may use this information for future marketing purposes regarding its products, including contacting the entrant electronically. The Promoter is bound by the Australian Privacy Principles in accordance with the Privacy Act 1988 (Cth) and its privacy policy which is located at www.exidebatteries.com.au/privacy/privacy. The Promoter's privacy policy contains information about how the entrant may access, update and seek correction of the personal information the Promoter holds about them and how the entrant may complain about any potential breach by the Promoter of the Australian Privacy Principles or any other Australian privacy laws and how such complaints will be dealt with. The Promoter collects personal information about entrants to enable them to participate in this Promotion and may disclose the entrants' personal information to third parties including its contractors and agents, prize suppliers and service providers to assist in conducting this Promotion and to the State and Territory lottery departments as required under the relevant lottery legislation. If the entrant does not provide their personal information as requested, they may be ineligible to enter or claim a prize in the Promotion. Personal information collected from entrants will not be disclosed to any entity located outside of Australia.

  16. For the purposes of public statements and advertisements, the Promoter may only publish the winner's surname, initial and State/Territory or postcode of residence.

  17. It is a condition of accepting the prize that a winner and their travel companion may be required to sign a legal release as determined by the Promoter in its absolute discretion, prior to receiving a prize.

  18. If a prize is provided to the Promoter by a third party, the prize is subject to the terms and conditions of the third party prize supplier and the provision of the prize is the sole responsibility of the third party and not the Promoter. The terms and conditions which apply to the prize at the time it is issued to the winner will prevail over these Conditions of Entry, to the extent of any inconsistency. The Promoter accepts no responsibility or liability for any delay or failure by the third party to deliver the prize, any delay or failure relating to the prize itself or failure by the third party to meet any of its obligations in these Conditions of Entry or otherwise.

  19. Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Conditions of Entry restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).

  20. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify suspend the Promotion and invalidate any affected entries, or suspend or modify a prize, subject to State or Territory regulation.

  21. The Promoter reserves the right, at any time, to validate and check the authenticity of entries and entrant's details (including an entrant's identity, age and place of residence). In the event that a winner cannot provide suitable proof as required by the Promoter to validate their entry, the winner will forfeit the prize in whole and no substitute will be offered. Incomplete, indecipherable, inaudible, incorrect and illegible entries, as applicable, will at the Promoter's discretion be deemed invalid and not eligible to win. Entries containing offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win. The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically enter repeatedly is prohibited and may render all entries submitted by that individual invalid.

  22. The Promoter reserves the right to disqualify entries in the event of non-compliance with these Conditions of Entry. In the event that there is a dispute concerning the conduct of the Promotion, the decision of the Promoter is final and binding on each entrant and no correspondence will be entered into.

  23. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence or wilful misconduct) in connection with this Promotion or accepting or using any prize (or recommendation), except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

  24. The entrant will participate in and co-operate as required with all reasonable marketing and editorial activities relating to the Promotion, including (but not limited to) being recorded, photographed, filmed or interviewed and acknowledges that the Promoter may use any such marketing and editorial material without further reference or compensation to them.

  25. Unless otherwise specified, a prize is a single event for the winner (and their guest) and cannot be separated into separate events or components.

  26. The Promoter accepts no responsibility for any tax implications and the entrant must seek their own independent financial advice in regards to the tax implications relating to the prize or acceptance of the prize.

  27. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.

Exide Batteries Express Nationwide Warranty

Our batteries are warranted against any manufacturing fault for the stated period or kilometres (whichever occurs first).  Should it not pass a standard battery test for any reason other than after-sale damage, neglect or misuse, it will be replaced free of charge by the dealer or their agents.  You may claim under the warranty by returning the battery to the place of purchase with the original purchase receipt and completed warranty card for the warranty adjudication procedure. 

This express warranty is given by MP Australia P/L 1-5 Winterton Road, Clayton 3168, Victoria Australia, Phone: 1800 800 811 in Australia and MP Limtited 149 Hutt Park Road, Lower Hutt 5043, Wellington, New Zealand, Phone 0800 651 611 in New Zealand. The benefits under this express warranty are additional to other rights and remedies under applicable laws in force in Australia and New Zealand

In Australia - our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be acceptable quality and the failure does not amount to a major failure.

Exide Battery products can be warranted at any location that sells Exide Technologies products around Australia and New Zealand. It is important that the consumer keeps their receipt.  The warranty period is not renewed or extended as a result of this replacement subject to your rights under the Australian Consumer Law.

       

Other factors that can cause premature failure of a battery include:

  • High Loads
  • Electrical System Faults
  • Faulty Terminals
  • Stop/Start Motoring
  • Sulphation
  • Other

Extended Warranty Offer

You receive an additional Extended Warranty period for registering your purchase with MP Batteries.

Registration of the extended warranty must take place within 10 days of the original purchase. Please keep your original purchase receipt and this extended warranty certificate in the event you need to exercise your warranty.

Extended Warranty terms do not transfer with ownership of the vehicle, therefore should the vehicle be sold during the Extended Warranty period the Extended Warranty on the battery becomes null and void. We reserve the right to request photo ID to clarify the consumer claiming warranty where the ownership of the battery maybe in question or differ from the name registered online during the Extended Warranty registration process.

In the event the exact date of battery purchase cannot be verified online or through an appropriate proof of purchase the batteries formation and charge date stamped onto the case of the battery will be used to evaluate the age of the product.
